House Resolution in the 110th Congress for a CEC holiday

House Resolution 76 has been re-introduced in the 110th Congress by Congressman Joe Baca (D-CA). The resolution urges the establishment and observation of a legal public holiday in honor of Cesar E. Chavez. Already, fifty-one Members of Congress have co-sponsored H.Res. 76 since January. While this resolution does not establish the holiday for Cesar Chavez, it is an important first step to getting Congress on record in support of a legal holiday for Cesar Chavez.

The establishment of a legal national Cesar Chavez holiday has been blocked by Republican representatives who introduced a rule that prohibits any bill from being introduced which expresses a commemoration (celebration, remembrance or recognition) of an individual (Rule XII, Clause 5).

In order for a Cesar Chavez federal holiday bill to be introduced, this rule must be overturned by the House by unanimous consent or by an amendment passed in the Rules Committee and then adopted by a majority in the House. Congressman Baca has written to Honorable Nancy Pelosi, Speaker of the US House of Representatives asking that she support efforts to remove the prohibitive rule so that a bill establishing a national Cesar Chavez holiday may be considered. As of the writing of this information, House Speaker Pelosi has not responded with an answer to the letter.
